In a significant legal development, Pretoria Magistrate Court has dismissed the bail application of Fannie Nkosi, an Organised Crime Unit member, and concurrently denied his request for placement in the Kgosi Mampuru II Correctional Facility’s hospital wing. The decision was reached during a court appearance on Monday, where Nkosi sought bail and expressed concerns about his health and potential poisoning in prison.
Nkosi, who has been charged with possession of state — owned ammunition, a hand grenade, and other firearms, argued that his diabetic condition necessitated medical care within the prison’s hospital wing. However, Magistrate Thandi Theledi ruled that his health concerns did not constitute a substantial reason for special accommodation. Theledi emphasized that the hospital wing is designated for prisoners requiring medical treatment, observation, or nursing care, not as a form of protective custody without medical necessity.
Despite Nkosi’s fears, Theledi clarified that the safety of all inmates, including Nkosi, would be ensured within the general population. “I am not going to micromanage the prison and say somebody must go here or somebody must go there. They will assess the need, they will assess the possibility, and they will make their own decision, “Theledi stated.
Nkosi’s case has garnered attention following his implication of himself and senior police officials in alleged ties to organised crime figures during testimony before the Madlanga Commission. His arrest came after authorities discovered a cache of weaponry and cash at his residence. His bail application will continue on April 20th, as the case is set to proceed.
